EVENT REGISTRATION AGREEMENT (27th FAPA Congress – 2018)

THIS IS A LEGAL AGREEMENT BETWEEN YOU (“REGISTRANT” or “YOU”) and the PHILIPPINE PHARMACISTS ASSOCIATION (“PPhA” or “HOST”) as participant and local host of the 27th Congress of the Federation of Asian Pharmaceutical Associations (“FAPA 2018” or “the Event”), respectively.

If you agree with the terms and conditions, check the box before the statement “I have read and agree with the FAPA 2018 Congress Registration Terms and Conditions” on the registration page. If you do not agree with the terms and conditions of this agreement, you will not permitted to register for this event. By proceeding with the registration, you are agreeing to be legally bound by all of the terms and conditions of this Event Registration Agreement (the “Agreement”).

TERMS AND CONDITIONS

1. The Host shall provide to the registrant: Access to the congress events/ activities and related program materials as specified for your registration category in the registration fees page. The Registrant is solely responsible for any fees and costs relating to attending the Event.

2. The Registrant Generally Agrees to the following:

a. Registrant will pay the full registration fee as indicated in Paragraph 4;

b. The Registrant attends the congress for his or her own personal education purposes, and shall not record, reproduce, or copy in any way, form, or manner, electronic or otherwise, any of the content of the FAPA congress without permission granted by the presenters/ authors.

c. The Registrant shall not, directly or indirectly, distribute, make available, publicly display, publicly perform, create derivative works from the content of the FAPA congress or portion thereof in any form or manner, including online without the permission of the presenters/authors;

e. The Registrant will not disrupt, disturb, or otherwise unduly interfere with the conduct of the Event, as determined by the Host.

f. The Registrant is not permitted to record any of the Event in any audio, video or other formats. No photography, video taping, filming, audio-recording, or the like is permitted without the express authorization of the Host.

3. Registration

a. Non-Transferrable and Non-Refundable Registration. Registration for the Event is not transferrable or assignable, nor may it be exchanged or returned, in full or in part, for a future event, seminar or class. Fees must be paid in full at the time of registration and are not refundable, except as otherwise provided herein. No refunds or credits will be granted for non-attendance or partial attendance.

b. Cancellation or Refund. The Host reserves the right to cancel the Event without notice, in which case, the Host will reimburse Registrant in full. If the Event is sold out, the Host will notify the Registrant and reimburse Registrant in full.

4. Fees and Payment Policy.

a. Full Payment Required. To reserve a space in the Event, you agree to pay the registration fees published by the Host and must make payment in full within the time set by the Host, prior to attending the Event.

b. Payment Processing Fees and other Charges. Payment must be made in the currency that the Host will accept, and any processing, currency conversion, bank transfer and other costs related to the payment process will be shouldered by the Registrant.

c. Additional Fees may be charged by the Host for activities or other products not included in the basic registration coverage.

5. Change or Cancellation. The Event or activities within the FAPA congress is subject to change or cancellation, for any reason. The Host reserves the right to change the published agenda for the Event, including changes to scheduled times and speakers, without notice.

6. Your Participation May be Recorded. By registering to this Event, you understand that portions of the event may be recorded in video and audio and/ or captured in still and/ or digital photographs. You hereby grant the Host and FAPA, its affiliates, successors, assigns and licensees the right and permission to use in perpetuity your name, likeness, photographic images, voice, and/ or testimonial(s), without compensation or prior review, in films and tapes for use in any and all media, throughout the world, at any time, for the purpose of advertising and publicizing the Host and FAPA’s products and services, including without limitation on its website and social media pages. The Host and FAPA owns all rights, title and interest, including intellectual property rights, in any audio, video, and/ or photograph captured during the Event and are released from any liability whatsoever of any nature. Do not proceed with the registration if you do not wish to be subject to the foregoing.

7. Warranties and Representations.

a. You represent and warrant that you are at least of the age of majority in your country of residence and have the right and the ability to enter into this Agreement or You are entering into this agreement with the knowledge and consent of your legal guardian.

b. In the event that Registrant breaches any of Registrant’s promises and warranties as set forth in this Agreement, Registrant agrees that, in addition to and without limitation of any other right or remedy to which the Host is entitled, the Host may terminate Registrant’s further participation in the Event, and any future program, and may revoke Registrant’s right to access the content and materials from the Event.

8. Intellectual Property Rights. You acknowledge that: (i) by attending the Event you may receive and/or have access to certain software, characters, pictures, digital images, graphics, music, video, audio, text and other creative and research output (collectively, “Content”), and (ii) this Content is owned by the Host, its suppliers, employees, licensors, representatives, business associates, advertisers, directors, agents, consultants, mentors, lecturers, invited speakers and independent contractors participating in the Event (collectively referred to as “Contributors”). You acknowledge that the Host, and other Contributors own all right, title and interest, including intellectual property rights, in their respective Content under copyright and other applicable laws and treaty provisions, and that except as described in this Agreement, such rights are not licensed or otherwise transferred by mere attendance or registration for the Event. You accept full responsibility and liability for your use of any Content in violation of any such rights. You also acknowledge that the Host is not responsible for any misuse of Content by third parties.

9. Program Materials. You also agree that all the materials displayed or distributed during the Event, or provided to you or which you may have access to in conjunction with the Event, including without limitation: class handouts, teaching materials, presentations, audio and video material or stills from audiovisual material, graphics, slides, drawings, pictures, characters, animations, text, and data, and all intellectual property rights therein (such as copyrights and trademarks) (collectively “the Program Materials”) are the sole and exclusive property of the Host or its Contributors. The Program Materials shall remain at all times the property of the Host and/or of the Contributors. You shall not copy, distribute, make available, display, publish, perform or create derivative works from (by electronic means or in any other way) the Program Materials or Content without prior written permission from the Host or Contributor. This includes forwarding or commercially exploiting the Program Materials or content. Neither this Agreement nor the Host’s disclosure or display of the Program Materials or Content shall be deemed, by implication or otherwise, to grant you any licensed interest or property right in, under or to any of the Program Materials or Content and any intellectual property rights therein.

10. Privacy Policy. By registering to the Event, you are subject to the Host’s Privacy Policy. During the online registration and/or enrollment process to use the Sites, You may be provided with and/or asked to select a login name and password. Your password and login information are for Your use only, and You are entirely responsible for maintaining the security of Your password and login. You agree not to use a third party’s account or password at any time, or to disclose Your password or login information to any third party. You shall keep Your account (“Account”) information confidential, including Your password, username, login and any other information related to Site access (“Account Information”), and inform the Host immediately if You suspect any unauthorized use of or access to Your password or upon the unintended and/or undesired disclosure to any third party of any portion of such Account Information. You shall not permit or allow any other person or entity to have access to or to use Your Account Information, absent the Host’s prior express written consent, and You shall at all times remain primarily responsible for all activity relating to Your Account Information. You also understand that personal may be required by the Host for verification purposes or for characterizing the participants in the Event and may be used to generate statistical reports.
You should be aware that if You voluntarily disclose Your personal information to the public on our Sites, including any bulletin board, forum, chat room or on any other user or member generated pages, that information might be collected and used by others and might result in unsolicited messages. The Host is not responsible for any use by third parties of information You make available publicly on our Sites.
You further understand that the Host disclaims all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to: (1) any errors in or omissions from our Sites, including, but not limited to, technical inaccuracies and typographical errors; (2) any third party websites or content therein directly or indirectly accessed through links in our Sites; (3) any information which is posted by any third party, including, without limitation, information posted on any related site or blog; (4) the unavailability of our Sites or any portion of this website; (5) Your use of our Sites; or (6) Your use of any equipment or software in connection with our Sites. You represent and warrant that: (a) all Account Information You submit is truthful, accurate, current and complete; (b) You will maintain the accuracy of such Account Information by updating and revising it promptly; and (c) Your use of our Sites does not violate any applicable law or regulation. You may select any log in name so long as, in our discretion, Your choice does not cause deception or confusion; does not violate any trademark right, copyright, or other proprietary right; or a name which we deem to be vulgar or offensive. We reserve the right to delete or change any login name for any reason or no reason.

11. Standards of Conduct. You understand that the Host may terminate your enrollment at any time if you fail to abide by the Host’s standards of conduct.

12. Acknowledgment of Risk; Waiver and Release From Liability.

a. You acknowledge that any participation in the Event is solely at your own risk. You hereby consent to voluntarily participating in the Event offered by the Host. You certify that you have full knowledge of the nature and extent of the risks inherent in any educational event, including injury, illness or death, and that you are voluntarily assuming these risks. You understand that the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death.

b. You, on behalf of yourself and your assigns and heirs, devisees and estate (collectively “Successors”), hereby unconditionally and forever release, discharge and agree to hold harmless the Host, and its affiliates, assigns and subsidiaries, along with each of its officers, directors, employees, volunteers, agents and contractors (collectively, “Released Parties”), from any and all claims, judgments, costs, damages, losses, expenses and liabilities (whether arising under a theory of contract, warranty, tort, strict liability, product liability or any other theory), relating to any claim you may now or hereafter have with respect to any death, personal injury, property damages, pecuniary loss or other loss, damage cost or expense (collectively “Harm”) that may be suffered by you or any third party as a result of, or in connection with, the Event, or any portion thereof, even if such harm is caused solely by the recklessness, negligence, or fault of one or more Released Parties.

c. You specifically understand and agree that this Release will prevent you and your successor(s) from bringing a lawsuit, claim or other action against any Released Party and from recovering any money damages or other legal relief from any Released Party in connection with any of the claims released above.

13. Indemnification. You agree to, and shall, indemnify, defend, and hold harmless the Host, and its, affiliates, subsidiaries, divisions, officers, directors, employees, representatives, agents, contractors, assigns and successors-in-interest (collectively “Releasees”) from and against any claim, demand, damage, cost or other expense (including reasonable attorney fees) asserted by any third party due to, arising out of, or in any way related to, any violation by you of this Agreement.
